Terms of Service

1. Scope

These Terms and Conditions (hereinafter referred to as “Terms”) apply to the use of the web application Evernox, operated by Leibetseder Digital Solutions e.U., accessible at app.evernox.com.

By using the application, users agree to these Terms.

2. Subject of the Contract

Evernox is a web-based tool that allows users to create and edit Entity Relationship Diagrams and to generate code based on these diagrams using OpenAI’s services.

The service is offered exclusively via paid subscriptions.

3. Registration and User Account

To use the services, users must register and create a personal account.
During registration, the following information is required:

  • First name

  • Last name

  • Email address

The user must ensure that the information provided is accurate and complete and is responsible for keeping access data confidential.

4. Conclusion of Contract and Subscriptions

The contract is concluded by the user selecting a subscription model and completing the payment process via Stripe.

The available plans and prices are visible on the website.

5. Prices and Payment

All prices are in euros and include applicable VAT.

Payment is handled securely via Stripe. By subscribing, the user agrees to Stripe’s terms of service and privacy policy.

6. Right of Withdrawal

Consumers residing in the EU have the right to withdraw from this contract within fourteen (14) days without stating a reason.
Details can be found in the Right of Withdrawal section.

If the user agrees that the service begins during the withdrawal period and acknowledges the loss of the right of withdrawal, this right expires once the service has been fully provided.

7. User Obligations

Users agree to:

  • Use the application only in accordance with these Terms and applicable law

  • Not upload unlawful, harmful, or offensive content

  • Not attempt to interfere with or manipulate the system

8. Intellectual Property and Licensing

All content generated by users belongs to the users themselves, provided it does not violate third-party rights.

Evernox and its features, designs, and code are protected by copyright and may not be copied, modified, or redistributed without permission.

9. Availability and Liability

We strive to ensure high availability of the service but do not guarantee uninterrupted access.

We are liable only for damages caused by intent or gross negligence. Liability for slight negligence, loss of data, or indirect damages is excluded to the extent permitted by law.

10. Use of Third-Party Services

Evernox uses external services, including:

  • Stripe for payment processing

  • OpenAI for automated code generation

The user consents to data being processed by these services under their respective terms and privacy policies.

11. Hosting and Server Location

The Evernox web application is hosted on servers provided by DigitalOcean LLC, located in a data center in Frankfurt, Germany.

By using Evernox, the user agrees that their data will be processed and stored on infrastructure located within the European Union, ensuring compliance with the GDPR.

12. Termination

The user can cancel the subscription at any time via the account settings.
The subscription will then not be renewed at the end of the current billing period.

The provider reserves the right to suspend or delete accounts in the case of violations of these Terms or applicable laws.

13. Final Provisions

These Terms are governed by the laws of Austria, excluding conflict of law rules.

If any provision of these Terms is or becomes invalid, this shall not affect the validity of the remaining provisions.

Jurisdiction for disputes arising from this contract is the competent court in Graz, Austria, unless mandatory consumer jurisdiction rules apply.
